Served as lead national counsel (though local counsel) for America’s Servicing Company in a case alleging unconscionable inducement of a mortgage loan in violation of the West Virginia Consumer Credit and Protection Act based on the terms of the loan, including the interest rate and the balloon feature, and the manner in which the loan was closed. Mr. Dowdy successfully removed the action over Plaintiff’s objection and obtained transfer to the bankruptcy court on the grounds that (1) diversity jurisdiction existed due to fraudulent joinder of a local notary public, and (2) bankruptcy jurisdiction also existed. The court granted summary judgment as to the unconscionability claim. The remaining services claims settled following the entry of summary judgment on the origination claim.
